Terms of Service

Welcome to EncoreEntry! These Terms of Service (“Terms”) govern your access to and use of the EncoreEntry web application and related services (collectively, the “Service”). By using the Service, you agree to be bound by these Terms.
1. About the Service
EncoreEntry is a SaaS web application that provides QR code-based attendance tracking for businesses running shows, events, or productions. Organizations can monitor cast and crew check-ins, manage emergency contact details, and generate headcounts in emergencies. The Service is operated by EncoreEntry and its subsidiaries (“we”, “us”, or “our”).
2. Who Can Use the Service
The Service is designed for use by businesses and organizations located in Canada and the United States. Users invited by organizations (including minors and adults) provide basic personal information (name, phone number, email, and an emergency contact). Organizations may also designate check-in managers who have access to participant data.
The Service is only available in English.
3. Accounts & Access
- Organizations and check-in managers must create accounts and keep their login credentials secure.
- Participants do not create accounts. Instead, they provide their information to receive a QR code, which is stored on their device. If they provide an email, they can retrieve their QR code via an emailed authorization code.
- You agree to provide accurate information when registering and to update it as needed.
4. Payments & Subscriptions
- Organizations pay to use the Service either annually or for a one-time 14-day access window.
- Renewals are manual; subscriptions do not auto-renew.
- Payments are processed securely via Stripe.
- No refunds are provided once payment is made.
5. Acceptable Use & Restrictions
By using the Service, you agree:
- Not to reverse engineer, decompile, or otherwise attempt to extract the source code of the platform.
- To keep your payment in good standing to maintain access.
- Not to engage in malicious, abusive, or unauthorized activity.
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Ownership & Data
- EncoreEntry and its subsidiaries own all rights, title, and interest in and to the Service and its content.
- Participant data is stored securely and is never shared externally, except where required by law.
- The Service does not display any public-facing user-generated content.
7. Security & Limitation of Liability
We take the security of your data seriously and implement commercially reasonable administrative, technical, and physical safeguards to protect it. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
By using the Service, you acknowledge and agree that:
- The Service is provided “as is” and “as available.”
- We strive to provide 99.9% uptime for the Service.
- To the fullest extent permitted by law, EncoreEntry and its subsidiaries disclaim all warranties, express or implied, and limit our liability for damages of any kind arising from or related to the use of the Service.
We are not liable for:
- Unauthorized access to, disclosure of, alteration of, or destruction of data that occurs despite our reasonable safeguards, including but not limited to data breaches, cyberattacks, malware, or other security incidents beyond our control.
- Data inaccuracies, loss, or deletion.
- Platform inaccessibility or downtime beyond the targeted uptime.
- The safety, location, or well-being of any participant, organization member, or other user of the Service.
8. Privacy
All collected personal data remains stored in Canada and is protected under Canadian data protection laws. For details, please see our Privacy Policy
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms or engage in behaviour deemed malicious, abusive, or outside the normal scope of use. Organizations may delete their accounts by contacting us.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of Canada. Any disputes arising under these Terms shall be resolved under Canadian law.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (e.g., by email or through the Service). Continued use of the Service after changes means you accept the revised Terms.
